INTRODUCTION

BrainCloud is a web-based artificial intelligence research tool built upon Alibaba’s DeepResearch technology. This Acceptable Use Policy (“Policy”) outlines the rules and guidelines governing your access to and use of the BrainCloud service. By accessing or using BrainCloud, you agree to be bound by this Policy. If you do not agree with any part of this Policy, you must immediately cease use of the service.
2. DEFINITIONS

BrainCloud: The web-based AI research tool developed and operated by Jeff Moe, individually.
User: Any person who accesses or uses the BrainCloud service.
Content: All text, graphics, images, data, and other materials generated or provided through BrainCloud.
Disallowed Content: Material that is illegal, harmful, abusive, obscene, or otherwise prohibited under this Policy.

ELIGIBILITY

By using BrainCloud, you affirm that:

You are at least 18 years old.
You are not a resident of any country within the European Union (EU) or its associated jurisdictions (including but not limited to Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden).
You are not designated as a “prohibited person” under U.S. law or international sanctions.

PERMITTED USE

You may use BrainCloud for lawful purposes, including but not limited to academic research, intellectual exploration, and professional development. Commercial use is permitted so long as it complies with this Policy. You may use the results of BrainCloud for lawful applications, provided such use does not violate any restrictions outlined below.
5. PROHIBITED CONDUCT AND DISALLOWED CONTENT

The following activities and types of content are strictly prohibited:

Illicit Activities: Using BrainCloud to facilitate any unlawful acts, including fraud, hacking, money laundering, or intellectual property infringement.
Harassment and Abuse: Engaging in harassment, stalking, bullying, or abuse directed at individuals or groups.
Obscenity and Lewdness: Generating, sharing, or using sexually explicit, pornographic, or indecent material.
Defamation and Hate Speech: Producing content that defames, discriminates against, or incites hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected categories.
Violence and Threats: Creating or disseminating content that advocates violence, physical harm, self-harm, or terrorism.
Illegal Products/Services: Facilitating the planning, manufacturing, or distribution of illegal items or services.
Malicious Activity: Attempting to disrupt, compromise, or exploit the functionality of BrainCloud or its users’ devices.
Automated Access: Using bots, scrapers, crawlers, or other automated methods without prior written permission.
Export Control Violations: Using BrainCloud in violation of U.S. export control laws or regulations.

RESTRICTIONS ON OUTPUT USAGE

You agree not to use the outputs, results, or insights generated by BrainCloud for any purpose that:

Infringes upon the rights of others;
Violates any local, national, or international law;
Promotes or enables dangerous or harmful activities;
Circumvents safety mechanisms or ethical filters implemented by BrainCloud;
Is intended for illicit or unethical research.

All outputs must be handled responsibly, with particular attention to potential misuse or unintended consequences.
7. SAFETY AND SECURITY

Users must not attempt to bypass or undermine any security features designed to prevent disallowed content generation.
Users are responsible for safeguarding their own devices and networks against unauthorized access or malware when interacting with BrainCloud.

DISCLAIMERS & LIMITATION OF WARRANTIES

BRAINCLOUD IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEFF MOE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY OF OUTPUTS.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF BRAINCLOUD. IN NO EVENT SHALL JEFF MOE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OR MISUSE OF BRAINCLOUD, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. DATA COLLECTION AND PRIVACY

As BrainCloud does not require user accounts, no personal registration information is collected.
To maintain security and operational integrity, BrainCloud may log IP addresses, request/response patterns, and usage metrics. These logs are retained only as necessary and will not be shared with third parties except as required by law.
Because users outside the EU are the only permitted users, this Policy does not invoke GDPR requirements.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jeff Moe and any related entities from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to your breach of this Policy or any unlawful conduct while using BrainCloud.
12. GOVERNING LAW AND JURISDICTION

This Policy shall be governed by and construed in accordance with the laws of the State of Colorado, USA. Any dispute arising from or relating to this Policy shall be resolved exclusively in the state or federal courts located in Loveland, Colorado.
13. TERMINATION

Jeff Moe reserves the right to suspend or terminate your access to BrainCloud at any time, without notice, for any reason, including but not limited to violations of this Policy, non-payment (if applicable), or changes in business operations.
14. CHANGES TO THIS POLICY

Jeff Moe may update this Policy from time to time. Continued use of BrainCloud after such updates constitutes your acceptance of the revised Policy. It is your responsibility to review this Policy periodically.
